End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you and KYND software and services. This Agreement governs your use of the KYND software, including all updates and documentation provided therein.
1. Acceptance of Terms
By downloading, installing, or using the KYND software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the software. The terms of this Agreement may be updated by KYND from time to time without notice to you.
2. License Grant
Subject to the terms and conditions of this Agreement, KYND grants you a non-exclusive, non-transferable, limited license to use the software solely for your internal business purposes. This license does not grant any rights to the source code of the software.
3. Restrictions
You shall not: (a) copy, modify, or create derivative works of the software; (b) reverse engineer, decompile, or disassemble the software; (c) rent, lease, lend, sell, or sublicense the software to any third party; or (d) use the software for any unlawful purpose or in any manner inconsistent with this Agreement.
4. Data & Privacy
Your use of the software is also governed by our Privacy Policy, which is incorporated herein by reference. KYND may collect and use technical data and related information to facilitate the provision of software updates, product support, and other services to you.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall KYND be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to the use of or inability to use the software, even if KYND has been advised of the possibility of such damages.
6. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from KYND if you fail to comply with any term(s) of this Agreement. Upon termination, you shall cease all use of the software and destroy all copies, full or partial, of the software.
